However, it is because of this situation that many are concerned, an approach that does not refer to better living conditions or the rights of the elderly. But because it is a challenge for today's society, which will have to adapt to functional capacity and health in old age, in addition to participation and social integration. 

And despite these challenges that are present, being elderly today in a developed country is not the same as it was decades ago when they did not even have rights or duties assigned.

How did the law on the rights of the elderly come about in Portugal?

Currently, the aging of the population requires reflection on the part of families, government officials and society in general. And this does not come from now, but from 1948 with the Universal Declaration of Human Rights which has in its article 25 the first reference to the rights of the elderly.

Another global concern regarding aging was in 1982, when the UN General Assembly (United Nations) promoted the first World Assembly on Aging, in which they created an International Plan of Action in Vienna.

After that, in 1990, the General Assembly of the United Nations established October 1 as the International Day of Older Persons, through Resolution 45/106, of December 16, 1990, the following year, in 1991, are approved, by through United Nations Resolution 46/91, the United Nations Principles on Older Persons.

A resolution contains a universal standard, with five main fields for older people. Check out:

  • principle of dignity: ensuring dignified living conditions, security and justice;
  • Principle of autonomy: where the purpose is to strengthen the autonomy of the elderly, offering decent income, access to personal training and active participation in the family and society;
  • Principle of personal development: to present the third age as a phase of development to be determined at the level of education, culture and leisure;
  • Principle of access to basic care: which focuses on health promotion;
  • Principle of active participation in society: materialize the expressed ideas of involvement of these individuals in policies that, directly or indirectly, interfere with their quality of life.

Social benefits available to elderly and sick citizens:

  1. Sickness allowance:

Refers to financial support through monthly installments in cases of temporary impediment to work due to illness (undeveloped resulting from work);

  1. Subsidy for child care:

In case of illness of a child, the citizen can have access to this subsidy to provide the necessary assistance to him, as long as both parents carry out a professional activity. If the parents are unable to care for their child, it is also possible for one of the grandparents to obtain a subsidy to care for their grandchild;

  1. Temporary disability:

It is made available to workers suspected of having an occupational disease that causes them to lose or reduce their ability to perform their work;

  1. Additional health benefits:

This benefit acts as a support to the citizen, reduces health costs for elderly people who receive the Solidarity Complement for the Elderly;

  1. Special drug reimbursement schemes:

Similar to the additional health benefit, the government of Portugal determines specific cases, according to the disease in which there may be support to reduce health costs for the citizen.
